By visiting our site and/or purchasing any tools, features, or products from the site, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service", "Terms"), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.
1. Overview
Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.
Any new features or tools which are added to the current store shall also be subject to the Terms of Service. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
2. Eligibility
By agreeing to these Terms of Service, you represent that you are at least the age of majority in the jurisdiction where you reside, or that you are the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use this site.
You are responsible for making all arrangements necessary for you to have access to the Services, and for ensuring that all persons who access the Services through your internet connection are aware of these Terms of Service and comply with them.
3. Products and Access
Golden Path Strategies runs an analytics platform for long-term, rules-based investing strategies: finished backtests of our proprietary strategies with their live positions, a portfolio builder that simulates mixes of strategies, and e-mail alerts (together with the website itself, the "Service"). In these Terms, "Content" means everything the Service shows or sends: strategy positions and signals (Long or Flat), charts and plots, backtested and live results, Buy & Hold comparisons, metrics, data, default portfolios, and e-mail alerts.
- Free access: anyone can view the Service without an account, except the latest 3 months of data.
- Paid plan: a paid plan adds the latest 3 months of data, e-mail alerts, bookmarks, and your own portfolios.
- Sign-in: you sign in with Whop, and signing in requires an active paid plan. There is no free account. We check plans every night; if your plan has ended, you are signed out. You can still download or delete your data through a data link sent to your e-mail address.
- No trading: the Service does not place trades, connect to a broker, or manage money.
- Legacy TradingView scripts: older Golden Path scripts listed on our TradingView profile are a legacy reference only. Access to them is not part of the Service or of any plan.
4. Subscription and Billing
We offer Monthly, Yearly, and Lifetime subscription plans, billed in Euros (EUR) through our payment processor and Merchant of Record, Whop. Whop handles payment processing, tax collection (including VAT), and subscription management on our behalf. By subscribing, you authorize Whop to charge your chosen payment method for the selected plan.
Auto-renewal: Monthly and Yearly subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You can cancel your subscription at any time through the Whop customer portal linked in your purchase receipt email.
Lifetime plans are one-time payments that grant access to the paid features of the Service, including current and future published strategies, for as long as Golden Path Strategies continues to operate. Access is non-transferable. We reserve the right to discontinue individual strategies or the service entirely with 90 days' advance notice; in such cases, Lifetime subscribers will receive a pro-rata refund or equivalent compensation at our sole discretion.
5. Refund Policy
Statutory Right of Withdrawal: Under EU consumer protection law, you have a 14-day right of withdrawal from the date of purchase for distance contracts. However, because our products are non-returnable digital goods that are immediately accessible upon delivery, you expressly waive this 14-day right by completing your purchase. This waiver is required because access to the paid features cannot be "returned" once delivery has begun. By purchasing, you acknowledge and agree that delivery begins immediately and that your statutory withdrawal right does not apply.
Notwithstanding the above, if you experience a technical issue that prevents you from signing in to the Service, please contact us at support@goldenpathstrategies.io within 7 days of purchase. We will make reasonable efforts to resolve the issue. If the issue cannot be resolved, we may, at our sole discretion, offer a partial or full refund.
Refund requests are processed through our Merchant of Record, Whop. Whop's standard refund policies may also apply depending on your jurisdiction and payment method. For disputes or chargebacks, please contact us first before initiating a dispute with your payment provider.
Chargebacks or payment disputes initiated without first contacting our support team may result in immediate termination of your access and refusal of future purchases.
6. Intellectual Property Rights
The Services and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Golden Path Strategies and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
We grant you a limited, non-exclusive, non-transferable license to view and use the Service and its Content for your own personal research and educational purposes. A paid plan extends this license to the paid features for as long as your plan is active. Use is also governed by our End User License Agreement (EULA). You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the Content, without our express written permission, except for downloading your own data.
You must not:
- Share, resell, sublicense, or redistribute the Content (including signals, alerts, and data) or your sign-in to third parties.
- Scrape, bulk-download, or copy the Content by automated means, or try to reconstruct the strategy rules behind it.
- Use the Service or Content to build competing products or services.
- Remove or alter any copyright, trademark, or other proprietary rights notices from the Content.
Violation of these restrictions will result in immediate termination of your license and access without refund.
7. Acceptable Use
You may not use our Services for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services.
We reserve the right to refuse Service to anyone at any time in our sole discretion for any or no reason, including if, in our opinion, you have violated any provision of these Terms of Service.
8. Limitation of Liability
To the fullest extent permitted by applicable law, Golden Path Strategies' total liability for any claim arising from or relating to these Terms or your use of the Services shall not exceed the total amount you paid for the specific product or service giving rise to the claim in the twelve (12) months preceding the claim.
Nothing in these Terms shall limit or exclude our liability for fraud, willful misconduct, gross negligence, or any other liability that cannot be limited or excluded under applicable law.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any dispute arising under these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, the dispute shall be brought before the competent court in Amsterdam, the Netherlands.
