This End User License Agreement ("EULA") is a legal agreement between you ("User", "you") and Golden Path Strategies ("Licensor", "we", "us") for the use of the Golden Path Strategies website and analytics platform.
In this EULA, the "Service" means the Golden Path Strategies website and everything in it. "Content" means what the Service shows or sends: strategy positions and signals (Long or Flat), charts and plots, backtested and live results, Buy & Hold comparisons, metrics, data, default portfolios, and e-mail alerts. "Paid features" means the latest 3 months of data, e-mail alerts, bookmarks, and your own portfolios, which require an active paid plan.
By purchasing a plan, accessing, or using the Service, you agree to this EULA. If you do not agree, do not purchase or use the Service.
1. License Grant
Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to view and use the Service and its Content for your personal research and educational purposes only. If you pay for a plan, this license includes the paid features for as long as your plan is active.
This license does not transfer ownership of the Service or Content to you. Portfolios, bookmarks, and alert settings you create remain yours, and you can download or delete them at any time.
2. Restrictions
You must not:
- Share, resell, sublicense, rent, lease, or redistribute the Content (including signals, alerts, and data) or your sign-in to any third party.
- Scrape, bulk-download, or copy the Content by automated means, or attempt to reverse engineer the Service or reconstruct the strategy rules behind the Content.
- Modify, adapt, or create derivative works based on the Content for anything other than your own personal use.
- Use the Service or Content to build competing products or services.
- Remove or alter any copyright, trademark, or proprietary rights notices.
- Circumvent any access controls or technical protection measures.
Violation of these restrictions will result in immediate termination of your license and access without refund.
3. Ownership
The Service, the Content, and all related intellectual property rights are owned exclusively by Golden Path Strategies. No rights are granted except as expressly stated in this EULA.
4. Access and Delivery
The paid features are delivered in this website when you sign in with Whop. Signing in requires an active plan; there is no free account. We check plans every night and sign out members whose plan has ended. After that you can still download or delete your data through a data link sent to your e-mail address. Access is non-transferable.
5. Updates and Support
We may update, modify, or discontinue strategies, portfolios, and features at any time. Updates are included while your plan is active. We are not obligated to provide support beyond reasonable efforts to resolve access issues.
6. Disclaimer of Warranties
THE SERVICE AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the Service or Content will be error-free, uninterrupted, or produce profitable trading results. Trading involves substantial risk of loss.
7. Limitation of Liability
To the fullest extent permitted by applicable law, Golden Path Strategies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or trading losses arising from your use of the Service or Content.
Our total liability for any claim relating to the Service shall not exceed the amount you paid for the specific product giving rise to the claim in the twelve (12) months preceding the claim.
Nothing in this EULA limits liability that cannot be limited or excluded under applicable law (including fraud or willful misconduct).
8. Trading and Financial Disclaimer
Golden Path Strategies is not a registered investment adviser. The Service, the Content, and related materials are for informational and educational purposes only and do not constitute financial advice. You are solely responsible for your trading decisions. Past performance, including backtests, does not guarantee future results.
9. Third-Party Platforms
E-mail alerts are part of the Service. We do not execute trades and are not responsible for decisions you make from those e-mails. Payments and sign-in are handled by Whop under its own terms. Legacy Golden Path scripts on TradingView are not part of the Service or of any plan, and this EULA does not grant access to them.
10. Termination
This license terminates automatically if you breach this EULA or our Terms of Service. Upon termination, you must stop using the paid features and Content beyond the free view. We may revoke sign-in access at any time upon termination.
11. Governing Law
This EULA is governed by the laws of the Netherlands. Disputes shall be subject to the competent courts in Amsterdam, the Netherlands, after good-faith negotiation.
